1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your use of the MyThikanas website at mythikanas.com, the websites we host for organizations on mythikanas.com subdomains, the MyThikanas marketplace, the management dashboard and the MyThikanas mobile apps (together, the "Service"), operated by MyThikanas ("MyThikanas", "we", "us").
By creating an account, accessing or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm that you are authorised to accept these Terms for that business. If you do not agree, do not use the Service.
2. The service
MyThikanas is software for operators of paying-guest accommodation, hostels and co-living spaces ("Operators"). It lets Operators manage properties, rooms, beds, tenants, tenancies, deposits, invoices, payments, complaints, expenses, inquiries and reports, and publish a website for their organization. It also lets people looking for accommodation ("Residents" or "Visitors") browse listings, request visits, complete onboarding, raise complaints and pay rent.
MyThikanas is a technology provider only. We do not own, operate, manage or inspect any listed property, and we are not a party to any rental, licence or tenancy agreement between an Operator and a Resident.
3. Accounts and security
- You must be at least 18 years old and provide accurate, current information when you register.
- You are responsible for everything that happens under your account and for the users you add to your organization, including the roles and permissions you give them.
- Keep your password confidential and tell us immediately at support@mythikanas.com if you suspect unauthorised access.
- To protect accounts, we may lock an account temporarily after repeated failed sign-in attempts and may end sessions when a password is changed.
4. Plans, trials and payments
- Plans. Operators use the Service on a subscription plan. The features, limits (such as the number of properties, rooms and beds), price and billing cycle of each plan are shown on our Pricing page and at checkout.
- Free trial. New organizations may receive a free trial. When the trial ends, paid features are locked until you buy a plan.
- Payment. Subscription fees are payable in advance for each billing cycle through our payment partner. Prices are in Indian Rupees unless stated otherwise, and applicable taxes may be added.
- Coupons. Discount coupons are subject to their own validity period, usage limits and eligible plans, and cannot be exchanged for cash.
- Renewal and expiry. If a subscription is not renewed, access to paid features and your organization's public website may be suspended until you renew.
- Refunds. Except where required by law or stated otherwise at the time of purchase, subscription fees are non-refundable once a billing cycle has started.
- Price changes. We may change plan prices for future billing cycles. Changes do not affect a cycle you have already paid for.
5. Rent collection and payment links
Operators can collect rent and other charges from Residents using invoices and payment links. These payments are processed by third-party payment gateways connected by the Operator. The Operator, not MyThikanas, is responsible for the amounts charged, receipts, refunds, deposits and any dispute with a Resident about a payment. Payment gateways' own terms apply to every transaction.
6. Operator responsibilities
If you are an Operator, you are solely responsible for:
- holding every licence, registration and permission required to run your property;
- complying with applicable laws, including rental, police-verification, consumer-protection, tax and data-protection laws;
- the accuracy of your listings, prices, photos, availability and amenities;
- obtaining Residents' consent before you collect or upload their personal data or documents, and using that data only for lawful purposes; and
- your agreements with, and conduct towards, Residents and staff.
7. Acceptable use
You must not:
- post false, misleading, discriminatory or unlawful listings or content;
- upload content you do not have the right to use, or photos of a property that is not yours;
- use the Service to send spam or to harass, defraud or impersonate anyone;
- access or try to access another organization's data, probe or bypass our security, or overload the Service;
- copy, resell, reverse engineer or build a competing product from the Service; or
- upload malware or use automated tools to scrape the Service.
8. Your content and data
You keep ownership of the content and data you put into the Service. You give us a limited licence to host, store, process and display it only to provide and improve the Service for you, for example to show your listings on your website and the marketplace. How we handle personal data is described in our Privacy Policy.
MyThikanas, its software, design, logos and trademarks belong to us and our licensors. These Terms do not give you any rights to them except to use the Service as permitted.
9. Marketplace and listings
Listings on the marketplace and on Operator websites are provided by Operators. We do not verify every listing and do not guarantee the quality, safety, legality or availability of any property. Residents should visit a property and review the Operator's agreement before paying any money. We may remove a listing that breaches these Terms.
10. Availability and changes
We work to keep the Service available and secure, but it is provided on an "as is" and "as available" basis and may occasionally be interrupted for maintenance, updates or reasons beyond our control. We may add, change or remove features from time to time.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or close an account that breaches these Terms, creates risk for other users or for us, or where required by law. On closure you may ask us, within a reasonable time, for an export of your organization's data, after which we may delete it in line with our Privacy Policy.
12. Disclaimers and limitation of liability
To the fullest extent permitted by law, MyThikanas is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. We are not liable for the acts or omissions of Operators, Residents, payment gateways or other third parties.
Our total liability for any claim relating to the Service is limited to the subscription fees you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify MyThikanas against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your dealings with Residents, Operators or other third parties.
14. Governing law and disputes
These Terms are governed by the laws of India. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally. Subject to that, the courts at our registered office have exclusive jurisdiction.
15. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date and, for significant changes, notify Operators by email or in the dashboard. Continuing to use the Service after a change means you accept the updated Terms.
